These terms govern your use of the 3rd Eye Australia website and any course you enrol in. By creating an account or purchasing a course, you agree to these terms.

1. Non-accredited training
All courses offered by 3rd Eye Australia are non-accredited. They are designed for skill development, workplace safety awareness and ongoing professional development (CPD). They do not lead to a nationally recognised qualification or Statement of Attainment under the Australian Qualifications Framework (AQF).
Some of our courses are aligned with units of competency from accredited training packages. Alignment means the underpinning knowledge overlaps, but completion of a 3rd Eye Australia course does not satisfy the assessment requirements of an accredited course. Where accreditation is required, students must complete formal assessment through a Registered Training Organisation (RTO).
2. Enrolment and account
- Enrolment is per student. You must not share your login or complete assessments on another person's behalf.
- You are responsible for keeping your account details, contact email and password secure.
- You confirm that the information you provide (including the name shown on your certificate) is accurate.
- We may suspend or cancel access if we reasonably believe an account has been shared, misused, or used to breach these terms.
3. Course fees and GST
All course prices are shown in Australian Dollars (AUD) and include GST unless stated otherwise. Fees are payable in full at the time of enrolment via our online checkout. Access to a course is granted after payment is confirmed.
4. Course access and completion
- Students receive online access to purchased courses for 12 months from the date of enrolment.
- Courses are self-paced. Progress, assessments and certificate issue are managed through your student dashboard.
- A certificate of completion is issued electronically (PDF) once all required lessons and assessments are successfully completed.
- Certificates issued by 3rd Eye Australia are records of course completion only; they are not nationally recognised qualifications.
5. Assessments and academic integrity
Assessments must be completed by the enrolled student without assistance that would misrepresent their knowledge. Copying, contract cheating, or falsifying identity or answers may result in cancellation of enrolment and revocation of any issued certificate, without refund.
6. Intellectual property
All course content — including slides, videos, images, assessments and downloadable resources — is owned by 3rd Eye Australia Pty Ltd or its licensors. You are granted a personal, non-transferable licence to view and use the content for your own learning. You must not copy, redistribute, publish, resell or use our content to deliver training to others without our written permission.
7. Third-party content
Some lessons may include videos and materials hosted by third parties. We do not control third-party services and are not responsible for their availability or content.
8. Acceptable use
You agree not to:
- Attempt to gain unauthorised access to the platform, other accounts, or our systems;
- Upload malicious code or content that is unlawful, offensive, or infringes another person's rights;
- Use the platform to harass, defame, or discriminate against any person.
9. Availability
We aim to keep the platform available at all times but do not guarantee uninterrupted access. We may perform maintenance, update courses, or withdraw content from time to time. Where a course is withdrawn during your active access period, we will provide reasonable alternative access or a pro-rata refund.
10. Consumer guarantees and liability
Nothing in these terms excludes any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot be lawfully excluded. To the extent permitted by law, our liability for any failure to comply with a consumer guarantee (other than a guarantee as to title, undisturbed possession or undisclosed securities) is limited, at our option, to:
- Re-supplying the course, or
- Refunding the fees paid for the course.
To the maximum extent permitted by law, we are not liable for any indirect, consequential, special or economic loss arising out of or in connection with your use of our courses or platform.
11. Not a substitute for professional advice or on-site training
Our courses provide general information and skill development. They are not a substitute for site-specific inductions, licensed operator training, or professional advice. Always follow your employer's procedures, applicable legislation and the guidance of qualified professionals.
12. AVA Premium Learning Support (AI tutor)
AVA is an optional AI-powered learning support service available as a paid membership. AVA explains terminology, simplifies concepts, answers general Australian WHS questions and can run mock interview practice. AVA is a study aid only — it does not assess competency, does not mark assessments, does not issue certificates and will not provide assessment answers.
AVA's responses are generated by artificial intelligence and may occasionally be incomplete or inaccurate. Nothing AVA says is legal, medical, engineering or professional advice. Always verify safety-critical information against current legislation, codes of practice, your employer's procedures and a qualified person. You use AVA's output at your own risk.
Fair use applies. Each membership includes a stated question allowance, and daily question limits apply to keep the service available and affordable for everyone. Current limits are shown on the AVA page, in your dashboard and before you purchase. We may suspend or cancel access where usage is automated, shared between people, abusive, or used to extract our course content.
Tutoring inside a course is restricted to courses you are currently enrolled in and have paid for. AVA memberships are personal, non-transferable and separate from course enrolments — cancelling a membership does not affect your course access, and refunding a course does not refund a membership.
13. Memberships, auto-renewal and top-up packs
Where you purchase an AVA membership or question top-up pack:
- Prices are in Australian Dollars (AUD) and include GST. The price, term length and question allowance are shown before you pay.
- If you turn on auto-renew, your membership renews automatically at the end of each term and the then-current price is charged to your saved payment method until you turn auto-renew off.
- You can turn auto-renew off at any time from your learner dashboard. Cancelling stops future charges; your membership stays active until the end of the term already paid for.
- Where a renewal payment fails, we may retry the payment and suspend membership access until it succeeds.
- Top-up packs are one-off purchases that add extra questions to your current membership. They are not subscriptions and do not renew.
- Unused questions do not roll over to a new term and are not exchangeable for cash or credit.
- Membership and top-up purchases are digital services delivered immediately. Change-of-mind refunds are not available once questions have been used, but nothing here limits your rights under the Australian Consumer Law.
- We may change membership pricing, allowances or limits. Changes to a renewing membership take effect from your next renewal and we will give you reasonable notice.
14. Changes to these terms
We may update these terms from time to time. The current version is always available on this page. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
15. Governing law
These terms are governed by the laws of Australia. Any dispute will be dealt with in the courts of the state or territory in which 3rd Eye Australia has its registered office.
