Privacy Policy

3rd Eye Australia Pty Ltd (ABN 27 158 281 193) ("we", "us", "our") respects your privacy and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Information we collect

We collect only what we need to deliver our online courses and run our business, including:

  • Identity and contact details: full name, email, phone number, company/employer (if provided);
  • Account data: username, encrypted password, sign-in method (email or Google);
  • Course activity: enrolments, lesson progress, assessment attempts and scores, certificates issued;
  • Payment information: transaction records. Card details are handled directly by our payment processor (Stripe) — we do not store card numbers on our servers;
  • Technical data: IP address, browser, device and log information used to secure and operate the platform.

2. How we use your information

  • To create and manage your account and enrolments;
  • To deliver course content, track progress and issue certificates;
  • To process payments and provide receipts and invoices;
  • To communicate with you about your account, purchases, and course updates;
  • To respond to enquiries and support requests;
  • To meet our legal, tax and record-keeping obligations;
  • To improve our courses and platform, and detect misuse or fraud.

We will not use your personal information for direct marketing without your consent. Where you opt in, you can unsubscribe at any time.

3. Who we share information with

We share your information only with service providers who help us run the platform, and only to the extent needed. These include:

  • Payment processing: Stripe (for secure card processing);
  • Hosting and platform infrastructure: our cloud hosting and database providers;
  • Authentication: Google (only if you choose to sign in with Google);
  • Email delivery: transactional email providers used to send receipts, certificates and account emails.

We may also disclose information where required by law, to protect our rights, or with your consent (for example, if your employer sponsors your enrolment and requests confirmation of completion).

4. AVA AI tutor and AI data handling

If you use AVA, our AI learning assistant, we also collect and handle:

  • The questions you type to AVA and the responses AVA gives you;
  • The course, lesson or interview topic you were viewing when you asked, so AVA can answer in context;
  • Your chosen language preference for bilingual explanations;
  • Usage records — number of questions asked, dates, and processing cost — used to apply your allowance, daily limits and fair-use caps;
  • Your membership, renewal and top-up purchase records.

To generate answers, your question and the relevant course context are sent to our AI model provider for processing. We do not send your name, email, payment details or certificate records to the AI provider, and we do not authorise our AI providers to use your conversations to train their public models. Processing may occur on servers outside Australia — see the overseas storage section below.

Our trainers may review learner questions for quality, safety and accuracy, and to build helpful FAQs for other students. Where a question is published as an FAQ it is de-identified first — your name, email and any personal details are removed. Please do not enter personal, medical, financial or confidential workplace information into AVA.

AVA conversations and usage records are retained so we can support you, resolve billing questions and monitor misuse. You can ask us to delete your AVA chat history at any time by emailing us; we may keep de-identified usage totals for accounting purposes.

5. Overseas storage

Some of our service providers — including our hosting, payment and AI model providers — store or process data outside Australia. Where this occurs, we take reasonable steps to ensure your information is handled consistently with the APPs.

6. Retention

We keep student and training records — including enrolment, assessment and certificate data — for at least 7 years so we can re-issue certificates and support auditing needs. We may keep some information for longer where required by law or for legitimate business purposes. When information is no longer needed, we take reasonable steps to delete or de-identify it.

7. Security

We use appropriate technical and organisational safeguards to protect your information, including encrypted connections (HTTPS), access controls and secure database hosting. No system is 100% secure — we encourage you to use a strong password and keep your account details confidential.

8. Cookies and analytics

We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the site is used. You can control cookies through your browser settings; disabling essential cookies may prevent parts of the platform from working.

9. Access, correction and complaints

You can request access to, or correction of, the personal information we hold about you by contacting admin@3rdeyeaustralia.com.au. We will respond within a reasonable period.

If you believe we have breached the APPs, please contact us so we can investigate. If you are not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

10. Changes to this policy

We may update this policy from time to time. The current version is always available on this page.
